I have noticed that if you dispute something through PayPal and you "win" your case this still does not mean that you will be able to get your money back and certainly not easily.

Not really sure. Sometimes its happen and i'm not get back my money. Its fine. I just contact the seller or buyer to pay me again.

If you win your case, then you have the right to demand that the money is returned to your account. Of course paypal will do that themselves by returning the money to you. However, I'm sure about the exact returned amount especially those funded by CC.

Well I know one time I won my case but no money ever came. I contacted PayPal and they said they are just a mediator and that they could not legally force the person to pay me back.

I think that could have been incase if the person did not have or keep any funds in the paypal. In that case how can you get your funds? Paypal wont pay it from their pocket

Cos i remember that a scammer charged back what he paid me and the amount was deducted from my balance and paid back to him.

I think so that if there are funds in the person paypal then paypal would revert those funds buit incase if there are no funds then how could they?

Hmmm...it is possible that the fund is no longer there and has already being emptied out. Usually once a dispute was lodged, paypal will place a temporary hold on your fund, but that is only possible if the money is still there.

The problem with this is (now I feel kinda bad but not really for this) is that people can dispute and claim back their cash but never send back a item or remove stuff or what ever. I know this is mainly aimed at sites, but heres a tale of woe:

I was on ebay looking for a cheap mp4 player (yep, wanted mp4) found one for £5 + £16 p&p. Got it, took a month to reach me and it was a bunch of pants, didnt work at all, I disputed it on ebay and paypal, was told to send it back for a replacement.

I went off on one about dodgy goods and how I didnt want a replacement, he ended up sending one anyway (I didnt know) then after more arguments he refunded my money and asked me to send it back to him, so I sent the broken one back, it was closed, he couldnt contact me anymore and I recieved a working one, free of charge.

So thanks to paypal closing it he couldnt ask for the new one back....

Cheeky huh?

(Please note it was a chinese rip off, it wasnt from a guy at home, it was a warehouse flogging dodgy stuff)

Wow, you mean you actually did that?? I'm sure the seller must be heartache then. Maybe if he had sent the item in good condition in the first place, I think you would have avoided the paypal chargeback.
